Terms of Service

1. Acceptance of Terms

By accessing or using the Shiftelio platform ("Service") at www.shiftelio.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all users, including business owners and employees.

2. Description of Service

Shiftelio is a Software-as-a-Service (SaaS) workforce management platform that provides GPS-based attendance tracking, employee scheduling, WhatsApp notifications, payroll reporting, and related tools for businesses to manage their workforce.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information and to update it as necessary.

4. Subscription and Billing

Certain features of the Service require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis. Payments are processed securely by Razorpay. All prices are stated in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service or its systems.
• Use the Service to collect or harvest personal data of others without their consent.
• Reverse engineer, decompile, or disassemble any portion of the Service.

6. Intellectual Property

All intellectual property rights in the Service and its content are owned by Shiftelio. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes in accordance with these Terms.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described therein. As a business owner, you are responsible for obtaining consent from your employees for GPS location tracking.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

To the maximum extent permitted by law, Shiftelio shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability to you shall not exceed the amount paid by you in the three (3) months prior to the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
