HR letter formats for Indian employers

Ten letters, each with a template you can copy and the part nobody publishes: what the document commits you to, which act reaches it and who that act actually covers.

Why this library is ten letters and not a thousand

The template is the cheap half. Anybody can publish the words “This is to certify that Mr X was employed with us”, and most of what ranks for these searches is exactly that, wrapped in a paragraph of filler.

What costs employers money is the part left out: that several states require you to hand over a service certificate whether or not the parting was friendly, that a warning letter written in generalities is worthless as evidence, that whether somebody counts as a workman under the Industrial Disputes Act decides what a termination costs and job titles do not settle it. Every page here carries that alongside the template, and names the act and the section so you can check it rather than take our word for it.

The library

Offer letter format

The document that proposes employment, before anybody has agreed to anything. It is conditional by design, and the conditions are the whole point.

Appointment letter format

The employment contract itself. In most states you are required to issue one, and the clauses people leave out are exactly the ones they later need.

Experience letter format

A statement of the facts of somebody employment: who they were, what they did, and for how long. It is not a reference, and the difference protects you.

Relieving letter format

The document confirming an employee has been formally released. Almost every Indian employer asks a new hire for one, which makes withholding it unusually consequential.

Resignation acceptance letter format

The letter that fixes the last working day. Fail to send it and the notice period becomes something both sides remember differently.

Warning letter format

The document that either builds a defensible record or destroys one. Most warning letters in Indian small business do the second thing.

Termination letter format

The riskiest letter an Indian employer writes. The obligations depend on whether the person is a workman, and most small employers have never asked the question.

Salary certificate format

Issued for a bank, a landlord or a visa. It states earnings, which makes it the one letter here that should never be handed to anybody but the employee.

Increment letter format

A variation to the employment contract, which is what makes the effective date and the arrears line worth getting right.

Internship certificate format

A certificate for someone who was not an employee. Saying so precisely is what keeps a stipend from being reread as a salary.

The two sequences that matter

Most of these letters are not issued alone. Two of them come in a fixed order, and issuing the wrong one at the wrong moment is where the avoidable disputes come from.

Somebody joining

offer letter, then appointment letter. The offer proposes and is conditional; the appointment letter is the contract. Sending only the first leaves you without the clauses that matter when things go wrong.

Somebody leaving

resignation acceptance letter, then relieving letter, then experience letter. The acceptance fixes the last working day, the relieving letter releases the person, and the experience certificate records what they did. The first is the one most employers skip, and skipping it is why the notice period ends up being two different dates.

Questions people ask

Which employment letters are mandatory in India?

There is no single central act that lists them. Most state Shops and Establishments Acts require a written appointment letter or written particulars of employment, and several require a service certificate on the termination of employment, which is what an experience letter is. The Industrial Employment (Standing Orders) Act 1946 adds requirements for the establishments it covers. Everything else, including the relieving letter, is market practice rather than statute, though market practice can bite just as hard when a new employer refuses to confirm a joining date without one.

What is the difference between an experience letter and a relieving letter?

An experience letter certifies the facts of employment: name, designation, dates and duties. A relieving letter confirms the person has been formally released, that notice was served or waived, and usually that the settlement is complete. A prospective employer asks for both because they answer different questions. Issue both on the last working day.

Can an employer withhold letters until the employee returns company property?

It is common and it is a weak position. Where a state Shops and Establishments Act or applicable standing orders require a service certificate, withholding it is a breach in its own right. Recovering a laptop or a loan is a separate claim with its own remedies, including lawful deduction from the full and final settlement, and the withholding is usually what a complaint to the labour authorities focuses on.

Are these letter templates legally valid?

They are drafted to reflect Indian practice and the statutes named on each page, but a template cannot know your state, your standing orders or your own contracts, and all three can change what a letter should say. Treat them as a well-informed starting point rather than a finished document, and take professional advice before acting on anything carrying a statutory consequence, particularly a termination.

What is the notice period rule in India?

There is no single statutory notice period for all employees. What applies comes from the contract of employment, from certified standing orders where the Industrial Employment (Standing Orders) Act 1946 covers the establishment, and from the Industrial Disputes Act 1947 where a workman is being retrenched, which requires one month notice stating the reasons or wages in lieu for a workman with not less than one year of continuous service. Thirty days by contract for confirmed staff is the common private-sector practice.

When must the full and final settlement be paid?

Where the Payment of Wages Act 1936 applies, section 5(2) requires wages payable to an employee whose employment is terminated to be paid before the expiry of the second working day after the termination. Statutory dues such as gratuity under the Payment of Gratuity Act 1972 are separate and carry their own timelines. In practice the settlement is often slower than the law allows, which is a common source of complaints.
