What is Shops and Establishments Act?

Also called S&E Act, shop act.

Definition

The Shops and Establishments Act is state legislation governing shops and commercial establishments: registration, working hours, weekly offs, leave, and record keeping. Every state has its own, and they differ.

How it works

For most non-factory Indian employers this is the act that decides the everyday questions: how many hours a day, which day of rest, how much leave accrues, what registers to maintain and for how long. Because it is state legislation, there is no national answer to any of those questions.

What it means in India

Registration under the applicable state act is usually required within a specified period of starting an establishment, and the leave entitlements, hours limits and prescribed registers differ between states. This is why copying an HR policy from a company in another state produces a policy that is wrong in specific and checkable ways.

What people get wrong

  • Assuming leave entitlements are national. They are among the most variable provisions between state acts.
  • Operating in several states and registering only where the head office is.
  • Using a register format prescribed by another state.

Earned leave. Earned leave is paid annual leave that accrues with days worked, usually carries forward, and is generally encashable on exit. It is the leave type most closely governed by statute.Attendance register. The attendance register is the record of who worked, on which days, and for how long. It is a statutory record for most Indian employers and the source of every figure in payroll.Weekly off. A weekly off is the statutory day of rest an employee is entitled to in each week. It is a requirement rather than a benefit an employer grants, and working through it triggers obligations.Standing orders. Standing orders are the certified conditions of employment for an industrial establishment covered by the Industrial Employment (Standing Orders) Act 1946, and where they apply they override conflicting terms in an individual appointment letter.
