What is Workman?
Also called workman under the Industrial Disputes Act.
Definition
Workman is a defined category under section 2(s) of the Industrial Disputes Act 1947, and whether an employee falls inside it decides which protections and which termination obligations apply to them.
How it works
The test turns on the nature of the duties actually performed rather than on the designation or the salary. People employed mainly in a managerial or administrative capacity fall outside the definition, as do those in a supervisory capacity above the wage threshold in the section.
What it means in India
This is the classification question that decides what a termination costs, because retrenchment of a workman with not less than one year of continuous service attracts the notice and compensation requirements of section 25F. Because the test looks at what somebody actually does, calling an employee a manager does not by itself put them outside the definition, and that gap is a frequent subject of Indian industrial adjudication.
What people get wrong
- Deciding the question from the job title. Titles do not settle it.
- Establishing the classification during a dispute rather than before a termination, when there is still time to act on the answer.
